1. Agreement to Terms
By accessing or using the MyCustomsInfo® platform and services (“Services”), you agree to be bound by these Terms and Conditions (“Terms”). If you disagree with any part of these Terms, you do not have permission to access or use our Services.
These Terms apply to all visitors, users, and others who access or use the Services, including but not limited to importers, exporters, customs brokers, and logistics companies.
2. Description of Services
MyCustomsInfo® provides AI-assisted post-clearance audit of customs declaration data, discrepancy identification, compliance monitoring and reporting. MyCustomsInfo® is an independent compliance auditor. It does not determine the tariff classification, customs value or admissibility of any entry, and it does not conduct customs business as defined under 19 U.S.C. §1641.
Our Services include but are not limited to:
- Automated audit of customs declaration data against supporting documents
- Identification of potential classification, valuation and origin discrepancies for review by the importer’s licensed customs broker or customs representative
- Validation of audit findings by experienced customs professionals (review of findings, not the preparation or filing of any declaration)
- Compliance monitoring, reporting and documentation
- Training needs identification
- Secure data storage and retrieval
3. Limitations of Service; No Customs Business or Representation
(a) MyCustomsInfo® is an independent compliance auditor. It is not a licensed customs broker, a customs attorney, or a customs representative.
(b) United States: MyCustomsInfo® does not conduct customs business as defined under 19 U.S.C. §1641. The tariff classification, customs value and admissibility to be applied to any entry are determined by the importer’s licensed customs broker. MyCustomsInfo® output does not constitute entry preparation, classification advice or customs broker services. Preparation and filing of entries, Post-Entry Amendments, Post-Summary Corrections, protests and drawback claims are performed by a licensed customs broker. (c) United Kingdom and EU: MyCustomsInfo® does not act as a direct or indirect customs representative within the meaning of Article 18 of the Union Customs Code, nor as a person making customs declarations to HMRC. Customs declarations and any correction, repayment or relief applications are submitted by the client or the client’s appointed customs representative.
(d) MyCustomsInfo® output is decision-support information. The client and its licensed advisers remain responsible for all regulatory determinations and filings.
4. User Accounts and Registration
To access certain features of our Services, you must register for an account. When you register, you agree to:
- Provide accurate, current, and complete information
- Maintain and promptly update your account information
- Maintain the security of your account credentials
- Accept responsibility for all activities under your account
- Notify us immediately of any unauthorised access or security breaches
You are responsible for maintaining the confidentiality of your account credentials and for all activities that occur under your account.
5. Acceptable Use Policy
You agree not to use our Services to:
- Violate any laws, regulations, or third-party rights
- Transmit false, misleading, or fraudulent information
- Interfere with or disrupt the Services or servers
- Attempt to gain unauthorised access to our systems
- Use automated systems to access the Services without permission
- Reverse engineer, decompile, or disassemble any part of the Services
- Remove or modify any proprietary notices or labels
- Use the Services for competitive analysis or benchmarking
6. Intellectual Property Rights
The Services, including all content, features, functionality, software, and materials, are owned by CustomsPlus® Limited (the operator of MyCustomsInfo®) and are protected by copyright, trademark, patent, trade secret, and other intellectual property laws. MyCustomsInfo® is a registered trade mark in the United Kingdom under Trade Mark Number UK00003864881.
You are granted a limited, non-exclusive, non-transferable licence to access and use the Services for your internal business purposes, subject to these Terms.
You retain all rights to the data and information you submit to the Services. By submitting data, you grant us a licence to use, process, and analyse that data solely to provide the Services to you.
7. Data Privacy and Security
We are committed to protecting your privacy and the security of your data. Our collection, use, and protection of your data is governed by our Privacy Policy, which is incorporated into these Terms by reference.
We implement industry-standard security measures to protect your data, including encryption, access controls, and regular security audits. However, no system is completely secure, and we cannot guarantee absolute security.
8. Fees and Payment
Access to certain Services requires payment of fees. All fees are stated in the currency agreed at the point of engagement unless otherwise specified. You agree to pay all applicable fees according to the pricing and payment terms presented to you.
We reserve the right to change our fees and pricing with 30 days’ notice. Continued use of the Services after the notice period constitutes acceptance of the new fees.
All fees are non-refundable unless otherwise stated or required by law. We reserve the right to suspend or terminate access to Services for non-payment.
9. Professional Advice Disclaimer
IMPORTANT: While our Services include validation by experienced customs professionals, the information and reports provided through our Services are for informational purposes only and do not constitute professional advice.
You should not rely solely on our Services for customs compliance decisions. We recommend consulting with qualified customs brokers, attorneys, or other professionals for specific advice related to your circumstances.
While we strive for accuracy, we make no warranties regarding the completeness, accuracy, or reliability of any information provided through the Services.
10. Limitation of Liability
TO THE MAXIMUM EXTENT PERMITTED BY LAW, MYCUSTOMSINFO SHALL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, OR ANY LOSS OF PROFITS OR REVENUES, WHETHER INCURRED DIRECTLY OR INDIRECTLY, OR ANY LOSS OF DATA, USE, GOODWILL, OR OTHER INTANGIBLE LOSSES.
Our total liability for any claims arising from or related to the Services shall not exceed the amount you paid to us in the 12 months preceding the claim.
Some jurisdictions do not allow the exclusion of certain warranties or limitations on liability, so some of the above limitations may not apply to you.
11. Indemnification
You agree to indemnify, defend, and hold harmless CustomsPlus® Limited (the operator of MyCustomsInfo®) and its officers, directors, employees, and agents from any claims, liabilities, damages, losses, and expenses arising from: (a) your use of the Services; (b) your violation of these Terms; (c) your violation of any rights of another party; or (d) your violation of any laws or regulations.
12. Termination
We may terminate or suspend your account and access to the Services immediately, without prior notice or liability, for any reason, including if you breach these Terms.
You may terminate your account at any time by contacting us. Upon termination, your right to use the Services will immediately cease.
Provisions of these Terms that by their nature should survive termination shall survive, including ownership provisions, warranty disclaimers, indemnity, and limitations of liability.
13. Governing Law and Dispute Resolution
These Terms shall be governed by and construed in accordance with the laws of England and Wales, without regard to conflict of law principles.
Any disputes arising from these Terms or the Services shall be resolved through binding arbitration, except that either party may seek injunctive relief in court for intellectual property infringement or violations of confidentiality obligations.
14. Changes to Terms
We reserve the right to modify these Terms at any time. We will notify you of material changes by posting the new Terms on our website and updating the “Last updated” date.
Your continued use of the Services after changes become effective constitutes your acceptance of the revised Terms. If you do not agree to the new Terms, you must stop using the Services.
